1. Who we are and what Crodrive is

The Crodrive platform (crodrive.com) is provided by MARGO NOVA d.o.o., Ulica Frane Cote 10, 10360 Sesvete, Croatia, VAT ID (OIB) 33335653053, registration number 081171370, entered in the register of the Commercial Court in Zagreb (the "Provider" or "we"). Contact: info@crodrive.com.

Crodrive is an advertising platform. We let car rental agencies publish their offer, and let users search that offer and send an enquiry to the agency of their choice.

Crodrive is not a party to the rental agreement. We do not rent out vehicles, we do not broker contracts, we do not take payment on behalf of agencies, and we do not guarantee the availability, condition or quality of any vehicle. The rental agreement is concluded solely between the user and the agency.

2. The relationship between user and agency

Sending an enquiry does not create a booking or any obligation for either side. An enquiry is simply a message passed on to the agency. The agency decides independently whether, and on what terms, to enter into a contract.

Everything to do with the rental — price, availability, collection and return, deposit, excess, insurance, the condition of the vehicle, damage, fines, fuel, border crossings, cancellation and refunds — is agreed between the user and the agency. The Provider takes no part in this and bears no responsibility for it.

3. Listing content and agency responsibility

Vehicle details, prices, terms and photographs are entered by the agency. The agency is solely responsible for the accuracy, completeness and lawfulness of its content, including photographs and the rights to use them, and for holding all permits required to operate a vehicle rental business.

We do not and cannot verify every detail. Reviewing a listing before publication is an editorial quality measure, not a warranty of accuracy, and it does not create liability on our part for the content.

The agency undertakes to indemnify the Provider against all claims, costs and damages arising from its content, from its relationship with a user, or from a breach of these terms.

4. Reporting problematic content

If you believe a listing breaches the law or infringes someone's rights, write to info@crodrive.com with a link to the listing and an explanation. We review reports without delay and remove content we find unlawful or in breach of these terms. We inform the person who reported it, and where relevant the agency, of the outcome.

5. Limitation of liability

The platform is provided "as is". We do not guarantee uninterrupted availability, freedom from errors, or that search results will match expectations. We may temporarily limit or suspend the service for maintenance or technical reasons.

To the fullest extent permitted by law, the Provider is not liable for:

• loss arising from the relationship between user and agency, including a rental agreement that is not concluded, is terminated, or is not performed;
• inaccurate, outdated or incomplete information entered by the agency, including prices and availability;
• the conduct, omissions or solvency of an agency or a user;
• lost profit, loss of data, or the cost of a replacement vehicle, accommodation or transport;
• unavailability of the platform or loss of messages for reasons beyond our reasonable control.

Should liability nonetheless be established, our liability towards an agency is limited to the amount that agency paid us in the three months before the loss arose.

These limitations do not apply to loss caused intentionally or by gross negligence, to liability for life and health, or in any case where limiting liability is not permitted by mandatory law — in particular towards consumers.

6. Your obligations

Send enquiries in good faith and with accurate details. Sending false enquiries, scraping content, attempting to circumvent security measures, and any unlawful use of the platform are prohibited. We may restrict access for anyone who breaches these rules.

7. Terms for agencies

7.1 Publication and approval

Registration is free. Listings are published immediately, without prior approval. We may reject or remove a listing that does not meet quality requirements — particularly where the photographs are not of that vehicle, where details are inaccurate, or where the category does not match the vehicle. We always give a reason for rejection.

7.2 Fees and payment

The advertising fee is charged per vehicle, according to category and the number of published vehicles, in line with the price list shown in the interface. It is paid in advance against a proforma invoice. Listings go live once payment has cleared. There is no refund for an unused period. A vehicle published during a paid period becomes visible immediately and is charged from the next renewal; no proportional refund is given for a vehicle removed during a period.

When the period ends, the agency moves to the free tier with one published vehicle; the remaining listings are hidden but not deleted.

7.3 How results are ranked

The order of vehicles in results is determined, in order of weight, by: distance from the searched location, confirmed availability for the requested dates, paid listing tier, and price. Position cannot be bought. There is no paid promotion, nor any other way for an agency to pay its way ahead of a closer vehicle. The paid tier only decides between vehicles at equal distance — the free tier ranks below paid ones — and never extends reach.

7.4 Availability and data

The agency must keep its details accurate and confirm availability. Vehicles without confirmed availability do not appear in date-based searches and fall in the ranking. This is not a penalty but a consequence: we cannot show as free what has not been confirmed.

7.5 Termination and changes

An agency may stop using the service at any time; a period already paid for runs to its end. We may restrict or withdraw access in the event of a breach of these terms, with reasons given. We give at least 15 days’ notice of changes to the terms or price list affecting agencies; an agency that does not accept them may terminate before they take effect.

8. Intellectual property

The name, mark, design and software of the platform belong to the Provider. By publishing content, an agency grants us a non-exclusive, royalty-free right to display that content on the platform and in promoting the platform, for as long as the listing is published and for a reasonable time thereafter in the archive.

9. Changes to these terms

We may amend these terms. The version in force is always published on this page with the date of the last change. Continued use after publication means you accept the amended terms.

10. Governing law and disputes

Croatian law applies. We aim to resolve disputes by agreement; failing that, the competent court in Zagreb has jurisdiction.

If you are a consumer, this clause does not affect your protection under the mandatory law of your country of habitual residence, nor the jurisdiction of its courts. You may send a complaint to info@crodrive.com, and the European Commission’s online dispute resolution platform is also available for out-of-court settlement.
